Terms of Service for Aura Health Podcast - Light Within

Welcome to the Light Within by Aura Health Podcast website, a subdirectory of Aura Health ("Aura," "we," "us," or "our"). This site hosts Light Within, our official podcast. By accessing or using Light Within, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use Light Within.
These Terms incorporate by reference Aura Health’s Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and safeguard your personal information.
1. Age Requirement for Use
Light Within is intended for users who are 18 years or older. If you are between the ages of 13 and 18, you may use Light Within only with the consent and supervision of a parent or legal guardian. Users under the age of 13 should not access, use, or provide any personal information through Light Within. By using this service, you confirm that you meet these age requirements. If we become aware that a user under 13 has provided personal information, we will take steps to delete such information in compliance with COPPA.
For users located in the European Union (EU) or other jurisdictions where the General Data Protection Regulation (GDPR) applies, the minimum age to provide personal data without parental consent may be higher. Users under the applicable age threshold should not use Light Within or submit personal data without verifiable parental consent.
2. Ownership and Intellectual Property
All content, including but not limited to audio and video podcasts, text, graphics, logos, and other materials (Podcast Content), is the exclusive property of Aura Health or its licensors. Unauthorized reproduction, redistribution, or modification of Podcast Content is strictly prohibited. Aura Health reserves all rights not expressly granted in these Terms, including all intellectual property rights, moral rights, and commercial exploitation rights over Podcast Content. This includes the exclusive right to modify, adapt, distribute, and monetize the Podcast Content in any form or medium, without restriction.
3. Restrictions on Use
You may access and use Light Within for personal, non-commercial purposes only.
You agree not to:
- Download, reproduce, distribute, or publicly display any Podcast Content without prior written consent.
- Modify or create derivative works from our Podcast Content
- Use any Podcast Content for commercial purposes without a licensing agreement.
- Circumvent or interfere with security features of Light Within
- Use Light Within in any manner that violates applicable laws or regulations.
4. Acceptable Use and Prohibited Conduct
Aura Health is committed to fostering an inclusive and respectful community. Light Within does not tolerate any form of discrimination, hate speech, or offensive conduct, including but not limited to content that promotes racism, sexism, homophobia, transphobia, xenophobia, ableism, or any form of intolerance based on identity, religion, national origin, sexual orientation, or disability.
4.1 Security and Misuse Prevention
To protect the integrity of Light Within, users agree not to:
- Attempt to gain unauthorized access to our systems, servers, or databases.
- Distribute malware, viruses, or other harmful technologies.
- Use automated scripts, bots, or scrapers to extract data from Light Within.
- Engage in any activity that could compromise the security of Light Within or its users.
- Impersonate Aura Health staff, representatives, or other users.
Users who engage in security violations or misuse may have their access to Light Within revoked and may be subject to legal action. Users agree to engage with Light Within in a respectful and lawful manner.
The following behaviors are strictly prohibited:
- Posting or transmitting any content that is defamatory, abusive, harassing, or promotes hate speech.
- Engaging in fraudulent, deceptive, or misleading activities.
- Using automated tools (e.g., bots, scrapers) to extract or manipulate content.
- Violating any laws or regulations while using Light Within.
Aura Health reserves the right to remove content, restrict access, or take legal action against users who violate these terms.
4.2 International Users
Users accessing Light Within from jurisdictions outside the United States are responsible for compliance with all applicable local laws and regulations. Aura Health does not guarantee that the podcast or associated content is appropriate or legally accessible in other countries or regions.
5. User-Generated Content
If Light Within allows users to submit comments, questions, or other content, the following terms apply:
- Users transfer full ownership of submitted content to Aura Health, granting Aura Health a perpetual, worldwide, irrevocable, sublicensable, and royalty-free license to use, modify, adapt, publish, translate, distribute, and display such content in any media.
- Aura Health reserves the right to edit, modify, or remove user-generated content at its sole discretion, without notice.
- Users must ensure that their content does not infringe on any third-party rights, including intellectual property, privacy, or publicity rights.
- Aura Health is not responsible for the accuracy, legality, or reliability of user-generated content and does not endorse any views or opinions expressed by users.
- By submitting content, you explicitly represent and warrant that you have all necessary rights, permissions, and consents to submit such content and grant Aura Health the stated license.
6. Guest Rights and Responsibilities
Aura Health does not endorse or assume responsibility for any opinions, statements, or information provided by guests on Light Within. The views expressed by guests are solely their own and do not necessarily reflect the views of Aura Health. Aura Health is not liable for any claims, damages, or disputes arising from guest statements.
If you are a guest on Light Within, you agree to:
- Grant Aura Health a perpetual, worldwide, irrevocable, sublicensable, and royalty-free license to use your name, voice, image, and likeness in connection with the podcast, in any format, now or in the future, without additional compensation.
- Waive all moral rights, including but not limited to the right of attribution and the right to object to modifications, in connection with the podcast episode.
- Waive any right to review, approve, or control the final version of the podcast episode in which you appear.
- Indemnify Aura Health against any claims related to your appearance, including but not limited to intellectual property violations or defamatory statements.
6.1. Content Removal
Requests from guests to remove or edit previously published episodes will be considered at Aura Health's sole discretion. While we strive to accommodate reasonable requests, we reserve the right to retain episodes and related materials that have already been published.
7. Links to Third-Party Sites
Light Within may include links to third-party websites or services for reference or convenience. Aura Health does not endorse, control, or assume responsibility for the content, policies, or practices of these third-party sites. Users should review the terms and privacy policies of any external websites they access through Light Within.
Light Within is also available on YouTube. However, by using YouTube, you are subject to YouTube’s terms of service and privacy policies. Aura Health does not control or assume responsibility for data collection or practices on YouTube. For more information, please refer to YouTube’s Terms of Service and Privacy Policy.
8. Advertising and Monetization
Light Within may feature advertisements, sponsorships, affiliate links, or other forms of monetization. By using the service, you acknowledge and agree that:
- Sponsored content or advertisements will be clearly identified as such.
- Aura Health may receive compensation for promotional content, but this does not constitute an endorsement of third-party products or services.
- Advertisers and sponsors are responsible for the accuracy of their claims, and Aura Health is not liable for any misleading or false advertising.
- Users may be exposed to personalized advertising based on their browsing behavior, subject to applicable privacy laws.
- Advertisements may be dynamically inserted, meaning the advertising content may vary for different users based on location, interests, or other factors.
- Aura Health does not control or verify the claims made by advertisers. Any concerns regarding an advertisement should be directed to the respective advertiser.
- Aura Health may, in the future, offer premium subscription options or other models that allow users to experience Light Within without advertisements, subject to separate terms.
- Some links shared within Light Within may be affiliate links, through which Aura Health may receive a commission if a purchase is made. We will disclose such links in accordance with the Federal Trade Commission (FTC) guidelines on affiliate marketing.

9. Content Advisory and AI Use
Light Within may discuss topics that include sensitive, mature, or explicit content. Listener discretion is advised. By using this service, you acknowledge that Aura Health is not responsible for how this content is perceived or interpreted. Additionally, some aspects of Light Within, including but not limited to transcriptions, translations, and content recommendations, may be generated or enhanced using artificial intelligence (AI) and automated systems. While we strive for accuracy, AI-generated content may contain errors or inconsistencies. Aura Health does not guarantee the completeness or accuracy of AI-generated outputs, and users should verify critical information independently.
10. Disclaimer of Warranties and Limitation of Liability
The content of Light Within is for informational and entertainment purposes only. The content provided does not constitute medical, psychological, legal, or financial advice. 10.1 No Warranties
YOU EXPRESSLY AGREE THAT YOUR USE OF LIGHT WITHIN IS AT YOUR SOLE RISK. THE SERVICE AND ALL CONTENT PROVIDED THROUGH LIGHT WITHIN ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
AURA DOES NOT GUARANTEE THAT:
- LIGHT WITHIN WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- THE CONTENT PROVIDED IS ACCURATE, RELIABLE, OR UP TO DATE.
- ANY ERRORS IN THE SERVICE OR CONTENT WILL BE CORRECTED PROMPTLY.
AURA HEALTH MAKES NO WARRANTIES REGARDING THE OUTCOME OR RESULTS FROM USING THE CONTENT PROVIDED THROUGH LIGHT WITHIN AND DISCLAIMS ANY RESPONSIBILITY FOR DECISIONS MADE BASED ON ITS INFORMATION.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AURA HEALTH, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, LOSS OF DATA, OR PERSONAL INJURY ARISING FROM YOUR USE OF LIGHT WITHIN, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Compliance with Copyright Laws and Reporting Violations
Aura Health is committed to maintaining a respectful and legally compliant environment on Light Within. All content shared on Light Within must comply with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA), and adhere strictly to these Terms of Service.
If you believe any content available on Light Within:
- Violates these Terms of Service (including hate speech, defamatory content, harassment, or prohibited conduct);
- Infringes on your intellectual property rights or other proprietary rights;
- Violates applicable laws, rules, or regulations;
- Contains false, misleading, or defamatory information;

11.2 Content Removal Policy
Aura Health reserves the right, at its sole discretion and without prior notice, to remove or restrict access to any content that violates these Terms, applicable laws, or poses a risk to the safety, privacy, or security of any individual. While Aura Health is not obligated to provide prior notice when removing content, we may offer an explanation upon request when appropriate.
12. Compliance with U.S. and California Laws
Aura Health operates in compliance with all applicable state and federal laws, including but not limited to the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), the California Online Privacy Protection Act (CalOPPA), the Children’s Online Privacy Protection Act (COPPA), and the Americans with Disabilities Act (ADA). As a user of Light Within, you have specific rights regarding your personal data and online interactions.

12.4 Data Retention Policy

- If you request the deletion of your personal data, Aura Health will comply within a reasonable timeframe, subject to applicable legal obligations.

13. Dispute Resolution and Arbitration
13.1 Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms, your use of Light Within, or any content provided through the platform shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in California, unless otherwise required by applicable law. The arbitration process, including all proceedings, submissions, evidence, and final decisions, shall be maintained as strictly confidential by both parties, except as required by law or agreed upon in writing.
13.2 Class Action Waiver
YOU AGREE TO WAIVE YOUR RIGHT TO FILE OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ARBITRATION. ALL CLAIMS MUST BE LITIGATED ON AN INDIVIDUAL BASIS.
If any portion of this arbitration clause is found to be unenforceable, the remainder shall still be enforceable, except where the class action waiver is deemed unenforceable, in which case disputes shall be brought in the state or federal courts of California.
13.3 Exceptions to Arbitration
Notwithstanding the above, Aura Health reserves the right to seek injunctive or equitable relief in state or federal courts regarding intellectual property rights or unauthorized use of Light Within, and to bring actions in small claims court where applicable.
13.4 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
14. Availability and Technical Requirements
Aura Health strives to ensure that Light Within is accessible and functional at all times. However, we do not guarantee uninterrupted or error-free service.
14.1 Service Availability
Light Within may be temporarily unavailable due to maintenance, updates, technical issues, or factors beyond our control, and Aura Health is not responsible for any interruptions, loss of access, or delays in service. We reserve the right to discontinue or modify Light Within at any time without prior notice.
14.2 Technical Requirements
Users are responsible for ensuring they have the necessary hardware, software, and internet connection to access Light Within, and Aura is not responsible for any incompatibility issues with devices or browsers.
15. Indemnification
Users agree to indemnify, defend, and hold harmless Aura Health, its officers, employees, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising out of their use of Light Within, violation of these Terms, or infringement of any third-party rights.
16. Termination of Access
Aura Health reserves the right to terminate or suspend access to Light Within if a user violates these Terms, engages in fraudulent or abusive behavior, or for any other reason at our sole discretion.
17. Modification of Terms
Aura Health may update these Terms at any time. Users are encouraged to review them periodically. Continued use of Light Within after updates constitutes acceptance of the revised Terms. If significant changes are made to these Terms, Aura Health will provide at least 30 days' notice before the changes take effect. Notice may be given through email notifications, prominent announcements on the website, or other reasonable means. While Aura Health will make reasonable efforts to notify users, we do not assume responsibility if a user does not become aware of these updates. If you do not agree to the updated Terms, you should discontinue use of Light Within before the effective date of the changes.
18. Feedback and Suggestions
Any feedback, suggestions, or ideas submitted to Aura Health regarding Light Within become the property of Aura Health, without compensation or obligation to the submitter. By providing feedback, you grant Aura Health a perpetual, worldwide, irrevocable, sublicensable, and royalty-free license to use, modify, adapt, and implement such feedback for any purpose, including but not limited to improving our services and developing new features.
